METHOD & TERMS


The Emma L. Hoerr Living Trust real estate will be sold on a price per acre basis, based on the surveyed acres. Tracts 1 - 3 will be offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can elect any individual tract or tracts (in any order) for their high bid. If the high bidder does not elect all the offered tracts, then the remaining tract(s) will continue to be offered “Buyer’s Choice” until all tracts have been elected. We will then offer Tract 4 individually as a lump sum total dollar amount. The tracts will NOT be offered together or in any combination at the conclusion of the auction.

Immediately following the auction, the successful buyer(s) will be required to sign a real estate sales contract and pay ten percent (10%) of the purchase price as a non-refundable down payment, payable to Mark Twain Title Co., which will be held in escrow until closing. The balance of the purchase price will be due at closing which will take place on or before May 3, 2024. Upon paying the 10% non-refundable down payment and providing proof of insurance, the buyer will be offered early possession with full farming rights for 2024.

The seller will provide title insurance in the full amount of the purchase price and pay the 2023 real estate taxes which are due and payable in 2024. The buyer will be responsible for the 2024 and all subsequent real estate taxes. Full possession will be given at closing, as the properties sell free and clear of tenancy for 2024. Bidding is NOT subject to any contingencies, including but not limited to financing, an appraisal or inspection of the property.
